Terms and Conditions
Welcome to www.tihaniswim.com. These Terms & Conditions (T&C) define the rights and obligations between TIHANI, a sole proprietorship registered in France (hereinafter “the seller”), and any individual placing an order on the site for personal use (hereinafter “the customer”).
Article 1: Seller Identification

Article 2: Products
The products offered for sale are swimwear presented on the site as accurately as possible (photos, descriptions, sizes, compositions). Slight variations may occur between the images displayed and the actual product received, depending on display screens.
Prices are indicated in euros. In accordance with Article 293 B of the French General Tax Code, VAT is not applicable. Shipping fees are added at checkout depending on the chosen destination.
Prices may be changed without prior notice. All credit card payments are charged in euros (€). If the customer’s local currency differs from the euro, conversion fees may apply, charged by the customer’s bank. Prices shown in currencies other than euros are for information purposes only. Additional taxes or fees may apply depending on the issuing country of the payment card and remain the responsibility of the customer.
Article 3: Orders
Once the order is confirmed, a confirmation email summarizing the order details will be sent to the customer. The sales contract is then considered concluded.
TIHANI reserves the right to refuse any order for legitimate reasons, including previous disputes with the customer, suspected fraud, payment failure, or incorrect or out-of-zone delivery address.
The customer is responsible for verifying the accuracy of the information provided when placing the order. In case of an error in the delivery address, any reshipment costs will be borne by the customer.
If an item becomes unavailable after an order has been validated, TIHANI will inform the customer as soon as possible. The customer may then request a full refund or replacement of the product, subject to availability.
Article 4: Payment
Payments are made exclusively online via the secure Stripe platform.
We accept major international credit and debit cards (including Visa, Mastercard, American Express, Discover, Diners Club, JCB, China UnionPay and Cartes Bancaires), as well as digital payment methods such as Apple Pay, Google Pay, Link, and any other payment options displayed at checkout.
Stripe applies Strong Customer Authentication (SCA) and 3D Secure 2 protocols in accordance with European regulations to ensure secure transactions. No banking data is stored or accessible by TIHANI at any time.
Payment is due immediately upon ordering. The customer must pay the full amount indicated, including applicable shipping fees. If the transaction fails, the order will be automatically canceled.
The customer guarantees that they have the necessary authorizations to use the selected payment method. Any fraudulent or improper use of the payment method may result in legal action.
Products remain the property of TIHANI until full payment is received. In case of non-payment, the order will not be validated or shipped.

Article 5: Shipping
TIHANI ships within the European Union and to French overseas territories.
Orders are processed within 2 to 5 business days after payment has been confirmed. Orders placed on Saturdays, Sundays, or French public holidays will be processed on the next business day.
Delivery times vary depending on the destination. Indicative delivery times are:
Mainland France: 1–3 business days from dispatch
EU (outside France): 2–6 business days from dispatch
French overseas territories: delivery times may vary depending on destination and customs processing
Delivery times are indicative and TIHANI cannot be held responsible for delays caused by carriers, customs authorities, or events beyond its control (e.g., weather conditions, strikes).
Shipping fees and available delivery methods are displayed before the order is confirmed. A tracking number is provided once the order has been dispatched.
The customer is responsible for providing accurate and complete delivery information. In the event of an error, additional reshipping costs will be borne by the customer.
Orders placed with delivery addresses outside the European Union and French overseas territories will be canceled and refunded.
Risk of loss or damage to the products transfers to the customer upon physical receipt of the goods.
Article 6: Right of Withdrawal
In accordance with the law, the customer has 14 days from receipt of the order to exercise the right of withdrawal. Items must be returned in their original condition, unworn, unwashed, with tags and original packaging.
When exercising the right of withdrawal, TIHANI will refund the price of the products as well as the standard shipping costs paid at the time of the order. Additional costs related to an express or specific delivery method chosen by the customer are non-refundable. Return shipping costs remain the responsibility of the customer.
To make a return, the customer must contact customer service at tihaniswim@gmail.com or via the contact form available at the top of our website (click “Contact us”), including your order number and reason for return. Refunds will be processed within 14 days of receiving the returned items.
These same rules apply to sale items.

Article 8: Intellectual Property
All texts, images, logos, designs, and content on the website www.tihaniswim.com are the exclusive property of TIHANI. Any reproduction, even partial, is prohibited without prior authorization.
Article 9: Personal Data
Personal data collected when placing orders or browsing the site is processed in compliance with applicable regulations (GDPR). For more information, please refer to our Privacy Policy.
Article 10: Legal Warranties
All products sold by TIHANI are covered by:
The legal warranty of conformity provided for in Articles L. 217-3 et seq. of the French Consumer Code, allowing the consumer to obtain repair or replacement of defective or non-compliant products within two years.
The legal warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code, allowing the consumer to obtain full or partial reimbursement for a product affected by a hidden defect that renders it unfit for use.

Article 11: Governing Law
These conditions are subject to French law. In the absence of an amicable solution, any dispute shall be submitted to the competent French courts, without prejudice to the consumer’s right to bring proceedings before the courts of their EU country of residence.
Article 12: Mediation and Dispute Resolution
The European Commission also provides an online dispute resolution platform, accessible here: https://ec.europa.eu/consumers/odr, which consumers can use to resolve any dispute related to an online purchase.
